  • You have read and understood these Terms.

  • You agree to comply with them.

  • You have the legal capacity to enter into a binding agreement.

  • You will provide accurate and complete information when using the website.

If you do not agree with these Terms, you must stop using the website and should not place an order.

3. Age and Eligibility

You must be at least 18 years old to make a purchase through the website.

Customers under the age of 18 may only use the website and place orders under the supervision of a parent, guardian or responsible adult.

We may refuse or cancel an order where we reasonably believe that the customer does not meet the legal eligibility requirements.

4. Permitted Use of the Website

You agree to use the website only for lawful and personal purposes.

You must not use the website to:

  • Violate any applicable law or regulation.

  • Submit false, inaccurate or misleading information.

  • Impersonate another person or organisation.

  • Attempt to gain unauthorised access to the website or its systems.

  • Upload or distribute viruses, malware or harmful code.

  • Interfere with the website’s operation or security.

  • Collect customer information without authorisation.

  • Carry out fraudulent purchases or payment activity.

  • Resell products in a way that suggests an official relationship with us without permission.

  • Copy or commercially exploit website content without written approval.

We may suspend or terminate access to the website where these Terms are violated.

5. Customer Accounts

Certain features of the website may allow customers to create an account.

Customers are responsible for:

  • Keeping account and login details confidential.

  • Ensuring that registered information is accurate.

  • Updating their phone number, email address and delivery details.

  • All activities performed through their account.

You must inform us promptly if you believe that your account has been accessed or used without permission.

To the extent permitted by law, we are not responsible for losses resulting from a customer’s failure to protect their account details.

6. Product Information

We make reasonable efforts to describe and display products accurately, including:

  • Product name.

  • Brand or roaster.

  • Weight.

  • Country of origin.

  • Processing method.

  • Roast level, where available.

  • Tasting notes.

  • Product images.

  • Price.

  • Stock availability.

Actual product colours, packaging or designs may differ slightly from the images shown because of screen settings, photography or packaging updates made by the manufacturer or roaster.

Coffee details may also vary between harvests or batches, including the roast date, packaging, tasting notes, lot number or season.

Tasting notes are provided as a general guide and do not guarantee that every customer will experience the same flavours. Coffee taste may be affected by the brewing method, water quality, grinder, grind size, equipment and personal preference.

7. Product Availability

All products are subject to availability.

A product may appear available on the website but become unavailable because of inventory updates, simultaneous purchases or supplier limitations.

Where a product becomes unavailable after an order has been placed, we may:

  • Contact the customer.

  • Offer an alternative product.

  • Provide store credit.

  • Refund the unavailable product.

  • Cancel the entire order where fulfilment is not possible.

The customer is not required to accept a substitute product.

8. Prices and VAT

All prices are displayed in United Arab Emirates dirhams unless otherwise stated.

Prices will include Value Added Tax where applicable or required by law. VAT may also be shown separately during checkout.

Product prices do not include delivery charges unless expressly stated.

We may change prices at any time. Price changes will not normally affect orders that have already been confirmed and paid, except where an obvious pricing error has occurred.

9. Pricing and Information Errors

We take reasonable steps to ensure that product descriptions, prices and availability information are accurate. However, technical, administrative or human errors may occur.

If a product has been listed with an incorrect price or materially incorrect information, we may:

  • Contact the customer to confirm the correct price.

  • Request payment of the difference with the customer’s approval.

  • Cancel the affected product or order.

  • Refund any amount already paid for the cancelled product.

We are not required to supply a product at an obviously incorrect price, even where an automated order confirmation has been issued.

10. Placing an Order

Submitting an order through the website constitutes an offer by the customer to purchase the selected products.

An automated confirmation message confirms that we have received the order but does not necessarily mean that the order has been finally accepted.

An order is generally accepted after:

  • Payment has been successfully confirmed.

  • Product availability has been verified.

  • Preparation has begun or the order has been handed to the courier.

We may refuse or cancel an order for reasons including:

  • Product unavailability.

  • Inability to verify payment.

  • Suspected fraud.

  • Pricing or technical errors.

  • Delivery restrictions.

  • Unusually large quantities or suspected unauthorised resale.

  • A breach of these Terms.

11. Payment

Orders must be paid using one of the payment methods displayed during checkout.

Available methods may include:

  • Credit or debit cards.

  • Apple Pay or Google Pay, where available.

  • Instalment services such as Tabby or Tamara, where available.

  • Other payment methods displayed on the website.

Payments may be processed by secure third-party payment service providers.

We do not normally store complete payment card details on our systems. Payments are also subject to the terms and policies of the relevant payment provider.

The customer confirms that they are authorised to use the payment method submitted.

12. Instalment Payment Services

Where a customer uses an instalment payment service, approval, payment schedules, fees, overdue payments and refund processing are subject to the provider’s terms.

We do not control whether an instalment application is approved or rejected.

Refunds for orders paid through an instalment provider may take additional time to appear or update within the customer’s payment plan.

13. Promotional Codes and Discounts

Promotional codes, coupons and discounts are subject to the terms communicated at the time they are offered.

Unless otherwise stated:

  • Only one discount code may be used per order.

  • Discounts cannot be exchanged for cash.

  • Certain products or brands may be excluded.

  • Promotional offers may have an expiry date.

  • Codes may be limited to one use per customer.

  • Delivery fees are not discounted unless expressly stated.

We may cancel a discount or order where a promotional code has been used incorrectly, fraudulently or contrary to its stated conditions.

14. Gift Cards and Store Credit

Where gift cards or store credit are offered:

  • They cannot be exchanged for cash unless required by law.

  • They must not be resold without our permission.

  • They may be subject to an expiry date or conditions stated at the time of issue.

  • The customer is responsible for keeping the code or card information secure.

We are not responsible for gift cards or store credit used without permission where the code was lost, shared or insufficiently protected by the customer.

15. Shipping and Delivery

Orders are delivered in accordance with our Shipping and Delivery Policy.

Delivery estimates are provided as guidance only and may be affected by:

  • Delivery area.

  • Public holidays.

  • Weather conditions.

  • Courier delays.

  • Customs or import delays.

  • Incomplete or incorrect customer information.

  • Circumstances beyond our reasonable control.

The customer is responsible for providing a complete and accurate delivery address and a working phone number.

Risk in the products generally passes to the customer once the order has been delivered to the address provided or accepted by an authorised recipient.

16. Failed or Refused Deliveries

If delivery cannot be completed because the customer is unavailable, does not answer, provides incorrect information or refuses the delivery, additional fees may apply.

Where an order is returned to us, delivery, return and handling charges may be deducted from any eligible refund.

A new delivery attempt may require payment of an additional delivery fee.

17. Returns, Exchanges and Refunds

Returns, exchanges and refunds are handled in accordance with our Return and Refund Policy.

Coffee and other food products may not be returned once opened, used or tasted, except where the product is defective, damaged, expired or different from the item ordered.

Eligible equipment and accessories must generally be unused, complete and returned in their original packaging.

Original delivery charges are normally non-refundable unless the return resulted from our error or a confirmed product defect.

18. Damaged, Defective or Incorrect Products

Customers must inspect their order after delivery.

Any damaged, defective, missing or incorrect product should be reported within the period stated in our Return and Refund Policy.

We may require:

  • The order number.

  • Clear photographs of the product.

  • Photographs of the internal and external packaging.

  • A photograph of the shipping label.

  • A video demonstrating the defect, where appropriate.

Customers should retain the product and packaging until the claim has been reviewed.

19. Order Cancellations

Cancellation requests should be submitted as soon as possible.

Orders may only be cancelled before preparation or dispatch has begun.

Once an order has been prepared, allocated, customised or handed over to the courier, cancellation may no longer be possible.

Approved refunds will be returned to the original payment method and may take several business days to appear, depending on the bank or payment provider.

20. Pre-Orders

Products sold as pre-orders are subject to our Pre-Order and Cancellation Policy.

Availability and arrival dates for pre-order products are estimates and may change because of supplier, shipping, customs or transportation delays.

Where an order contains both in-stock and pre-order products, the order may be held until all products are available unless separate delivery is agreed.

21. Product Care and Storage

Customers are responsible for following any storage, preparation and care instructions supplied with the product.

Coffee should generally be stored:

  • In a cool and dry place.

  • Away from direct sunlight.

  • Away from heat, humidity and strong odours.

  • Inside its original packaging or a suitable airtight container.

We are not responsible for deterioration or damage caused by improper handling or storage after delivery.

22. Equipment Warranties

Some coffee equipment or accessories may be covered by a manufacturer or supplier warranty.

Warranty duration and coverage may vary by product.

A warranty may not cover:

  • Normal wear and tear.

  • Accidental damage.

  • Misuse or improper installation.

  • Damage caused by incorrect voltage or power supply.

  • Failure to follow the manufacturer’s instructions.

  • Unauthorised repairs or modifications.

  • Damage caused by water, scale, impact or poor maintenance.

Where applicable, the customer may be required to contact the manufacturer or authorised distributor directly.

23. Intellectual Property

All website content, including logos, brand names, graphics, product descriptions, photographs, videos, designs, text and website layout, is owned by or licensed to Ninety One Degrees unless otherwise stated.

You must not copy, reproduce, modify, publish, distribute, sell or commercially use any part of the website without prior written permission.

Third-party trademarks, brand names and product images remain the property of their respective owners.

Where customers submit reviews, photographs, comments or other content, they confirm that:

  • The content is accurate and based on their genuine experience.

  • They have the right to submit it.

  • It does not infringe another person’s rights.

  • It is not unlawful, abusive, misleading, offensive or defamatory.

By submitting content, the customer grants us a non-exclusive right to use, reproduce and display it for website, marketing and promotional purposes, subject to applicable law.

We may remove submitted content that violates these Terms.

25. Third-Party Links and Services

The website may contain links to third-party websites, payment services, courier platforms or social media pages.

These services are operated independently and may have their own terms and privacy policies.

We are not responsible for the content, availability, security or practices of third-party services.

Accessing an external website or service is at the customer’s own discretion.

26. Website Availability

We aim to keep the website available and functioning properly, but uninterrupted access is not guaranteed.

We may temporarily suspend, update or restrict access for reasons including:

  • Maintenance.

  • Security updates.

  • Technical failures.

  • System upgrades.

  • Events beyond our reasonable control.

We are not responsible for temporary website interruptions or delays that are beyond our reasonable control.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Ninety One Degrees will not be liable for indirect, incidental, special or consequential losses arising from the use of the website or products.

This may include loss of profit, business opportunity, data or anticipated savings.

Where liability cannot legally be excluded, our total liability will generally be limited to the amount paid by the customer for the affected product or order.

Nothing in these Terms excludes liability that cannot legally be excluded under United Arab Emirates law.

Any dispute will be subject to the jurisdiction of the competent courts of the United Arab Emirates, unless applicable consumer-protection law requires otherwise.

33. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in full force.

The invalid provision will be interpreted or amended only to the minimum extent necessary to make it enforceable.

34. Entire Agreement

These Terms, together with all policies referenced on the website, form the entire agreement between the customer and Ninety One Degrees regarding website use and purchases.
